By accessing or using any website, portal, mobile application, telehealth platform, or digital service (collectively, the “Services”) operated by Mobile Psych PLLC ("Mobile Psych," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
The Services are intended for individuals age 18 or older who reside in the United States and are legally able to consent to treatment. You represent that you meet these criteria.
Information on the Services is for general educational purposes only and is not a substitute for direct, personalized medical advice. If you think you may have a medical emergency, call 911. We provide professional services only through a licensed clinician–patient relationship established via in‑person or telehealth encounters.
Mobile Psych delivers certain psychiatric, psychotherapy, neuromodulation (e.g., TMS + VR), and smoking‑cessation services via telehealth. State telehealth laws vary; you may be asked to verify your location before each session, and some services may be unavailable in your state. Prescriptions are issued only when clinically appropriate and legal. We do not dispense controlled substances.
You agree to:
You are responsible for all fees disclosed at signup, including program fees (e.g., accelerated TMS packages, Qwitly subscription) and medication costs. Unless otherwise stated, fees are due in full at the time of booking or enrollment and are non‑refundable once services are rendered. You may cancel future‑dated appointments up to 48 hours in advance to avoid no‑show charges.
All content, trademarks, graphics, and software on the Services are owned by Mobile Psych or its licensors and are protected by U.S. and international laws. You may view or download material for personal, non‑commercial use only. Any other use, including reproduction, distribution, or modification, is prohibited without written permission.

The Services may contain links or integrations (e.g., Setmore scheduling, payment processors) operated by third parties. Mobile Psych is not responsible for their content or practices. Use of third‑party services is at your own risk and subject to their terms.
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR‑FREE, OR FREE OF VIRUSES. YOUR USE IS AT YOUR SOLE RISK.
To the fullest extent permitted by law, Mobile Psych and its officers, directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
You agree to indemnify and hold harmless Mobile Psych and its affiliates from any claim, loss, or demand (including attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.
Any dispute arising under these Terms shall be resolved through binding arbitration administered in Bexar County, Texas, under the Commercial Arbitration Rules of the American Arbitration Association. By using the Services, you waive your right to a jury trial or to participate in class‑action litigation.
These Terms are governed by the laws of the State of Texas without regard to conflict‑of‑laws principles.
We may modify these Terms at any time. Material changes will be posted on the Services and reflected in the “Effective Date.” Continued use after changes constitutes acceptance.
